Questions? Just ask!

Talk with a lawyer, typically immediately or on the same day. It’s free, and you don’t need to have any paperwork on hand.

You know the grind: 60-hour weeks, dock waits, traffic jams, back pain, sleeping in your trailer, and on-call hours that no one counts.
And your company says, “Federal law doesn’t require overtime for drivers.”

They’re half right.

Truckers Working Long Hours? But Don’t Get Paid Overtime?

If you are based in WA, you qualify for overtime. Period.

Under the Federal Motor Carrier Act, many drivers miss out.

But under Washington’s wage laws, the exemption doesn’t apply. In fact, the  Washington Supreme Court also ruled Washington-based truck drivers should be paid overtime on all hours worked, including hours spent driving out of state. (Bostain v. Food Express, Inc., 159 Wn.2d 700, 153 P.3d 846 (2007)).

That’s right: you should count ALL the hours your worked for overtime pay both inside and outside of Washington.

“I’ll get fired if I say anything.”
→ Wrong. Retaliation is illegal. I've never seen a driver fired for speaking up.

“I signed a contract — doesn’t that block me?”
→ No contract can erase your legal right to overtime.

“They said I’m an independent contractor.”
→ If they control your schedule, routes, or pay method — you might still count as an employee.

“It’s not worth my time.”
→ You can recover 3 years of back pay and potentially even double that. And if you win, the company has to pay your attorney’s fees.

Washington Truck Drivers:

Work more than 40 hours? You could be owed Overtime Pay!

Washington law says if you drive more than 40 hours a week, you’re owed time-and-a-half — even if you’re paid by the mile, load or commission.

Federal law might not — but Washington state law does.
If you’re working more than 40 hours a week in Washington, you’re entitled to overtime pay at 1.5 × your regular rate, no matter how you’re paid:

• By the mile
• By the load
• By the hour
• On commission
• Flat day or week rate

You know the grind: 60-hour weeks, dock waits, traffic jams, back pain, sleeping in your trailer, and on-call hours that no one counts.
